Legal Question in Criminal Law in Colorado

underage drinking ticket, false info

If an officer puts the wrong blood alchohol content on an underage drinking ticket, is it still valid? (the mistake was pointed out, and acnoledged by the officer, but not corrected)

Re: underage drinking ticket, false info

Generally no, but that information may help a defense to the charge. The BAC is evidence of drinking, but it is not needed to win the case, so even if it was suppressed, the case can proceed to trial.
