Legal Question in Criminal Law in Colorado

Workplace theft

At work one night a customers wallet was found, it was given to me and i placed it under our front counter...we then became busy and i forgot about .. the next day the owner of the wallet came to inquire whether or not we found it.. however it was missing and now he is angry claiming it contained a large sum of money... he has now decided to involve police... am i in anyway liable for the wallet even though i had been observed putting the wallet under the counter and I was not the last to leave work, my shift had ended almost 2hours before everyone else left... no one working that night claims to know where the wallet went.. Any help is appreciated

Hello:

The criminal charge of theft requires that the actor have a specific intent to deprive an owner of his or her property. For there to be founded charges against you here, the police would have to develop probable cause to support that you intended to or knowingly deprived the person of the wallet. If your facts are as you say, there is no probable cause to support any charge of theft.
