Legal Question in Personal Injury in Colorado

I was involved in an vehicle accident. The other driver ran a red light. He was drunk and high on drugs.

The vehicle belonged to his mother. He was not on the policy. Is the mothers insurance responsible for paying for the vehicle and medical bills? They are telling that they are not because he was not listed on the policy.
