Legal Question in Real Estate Law in Colorado

Changing Land Use Regulatios

Is there a fair possibility that a Government subdivision could deny one use of a rural residenc, in use for more than 30 years, due to upgraded wetlands potections, that make installation of a new, necessary septic system impossible within the restrictions of the current regulations? That is, currents regs would not allow, but house and tank/leachfield have been in place for decades.

Re: Changing Land Use Regulations

Afternoon,

Ultimately they can deny the use. You can proceed to appeal that decision under the government procedure and then, ultimately, with the courts.

A useful understanding would require more information on the property and the regulations. Good luck.
