fines for late rent

I have always thought by Colorado state law, I had until the fifth of the month to pay rent. I have lived at my current apartment for almost two years, I almost always payed my rent on the first. The few times I payed rent between the 2nd and the 5th, my landlord said nothing about it. I payed my rent on the 3rd of january and was charged a fine. Is this legal?

Re: fines for late rent

Your contract is what governs. Generally it is legal to impose the fine. There is an argument that the landlord waived the fine. You have to determine how much time and effort you want to spend on this.
