Home Builder landscaped front yard with wrong tree

Our homebuilder put the wrong tree in our front yard. The tree's roots are now threatening the foundation of the house, driveway, sidewalk. We have a 10 year structural warranty on the house and have lived there 6 yrs. Do they have an obligation to remove the tree. It is a Cottonwood and extimated cost would be around 2-3 thousand.
