change of case title

I am being sued next week.I was served with a summons in May 2002.The complaint was breach of contract ,4 year open book. The last time i paid anything on this credit card account was in July of 2001. It seemed to have been forgotten about until now.Now the court files are changed and the action form has my case listed as collections. Is it too late to do anything about it.Can I file for dismissal on grounds that it has been 4 years since I used this account. l appreciate any feedback I can get Thanks.

from the basic facts given so far, you would have a procedural argument to have the case dismissed with prejudice, effective immediately, based on the 4 year statute of limitations period applied to contract law. if you would like further assistance or direction, contact us today.
