Legal Question in Family Law in Connecticut

contempt of court divorce decree settlement

I have to return to the stamford ct family court to file an order of contempt against my exhusband for failing to make the final house settlement payment that was due sept.1,2008.Is the proper form ''motion for contempt.''I also want to file an ''application for a contempt order'' for the missing 401 K money that was stripped from the 401 K account, lied about by my exhusband and his lawyer and never confronted along with stripped shared bank accounts. Is this the proper form to use to file for the illegal act of removing money while in the middle of divorce court proceedings in 2003.

Re: contempt of court divorce decree settlement

If he did not pay you the final settlement payment due Sept. 1, 2008, then, yes you can file the "motion for contempt" form, post judgment. Remember that you must serve him by marshal with the motion after you get a court date from the clerk.

As far as the "missing money" issues, if you knew about this prior to your divorce being finalized, then it is most likely too late to complain about it now. If you just found out about it, six years later, then maybe you still have a claim.

You should talk to a lawyer.
