Husband left family home 5 weeks ago...served divorce papers 1 week ago...house in both names...what options will be availabe regarding what happens to home

The house is a joint asset. The divorce court will decide who gets the equity (if any) just as it will regarding all other assets, including retirement plans, IRS's, 401K's, cars, bank accounts, brokerage accounts and debts. Neither of you can do anything with the assets at this point because of the Automatic Orders with which you were served along with the other divorce papers. If there are significant assets, or if there is such a disparity of incomes that alimony is likely, you had better see an attorney ASAP.

In the final settlement or at trial, either of you can buy the other out or the house is sold.
