Legal Question in Wills and Trusts in Connecticut

Divorce Decree and Death

When my parents got divorced in 1986 it said in the divorce decree that he had to pay my college, irrevocably keep me on a 50,000 life insurance plan and be a pension beneficiary. He never paid for my school, told me he was broke. When he passed away I found out he had over 500,000 dollars in the bank and his house was paid off (valued at 400,000). If everything is joint with my step-mother, am I still able to sue the estate for this? He cashed out of his life insurance and took me off his pension!

Re: Divorce Decree and Death

This is a very tough question and not easy to answer based upon the facts you stated.

First of all, when did he die? Is there an estate that is open in probate court? If not, it becomes more complicated.

You may have an action as a third party beneficiary of your parents divorce decree, but it is too difficult for me to really give my opinion based upon the facts you have provided.

I suggest you consult an attorney.
