estate distribution through probate court

My husband's mother passed away without a will. He and his brother are the only 2 heirs. Most property has been sold but the house. My brother in law wants to give us the house as we have a family and he does not. THe probate court is saying one brother must buy the other out or the court will sell the house out from under us (we live in it) and divide the money between the brothers.

Can a probate court force this family to do that?

The court does have the power to divide the home and or its proceeds. This is so because of the shared interest in the home.
