mothers estate 12/10/06

10 wks ago mom died. her husband is executor/per-rep. do i as a child have a right to ask for a copy of will, it's not been filed yet? is there always another person on will as fiduciary/trustee? mom told me she changed hers. i'd wish to speak with them. do i have the right to request a copy of will from her attor, and to who her fiduciary is and their # so i may speak with them?

first of all, as a beneficiary of a will (if you are) you have every right to receive a copy or go down to the probate court in your town and read it..it should be in the probate court file. You should ask the probate judge for a hearing to answer you questions. Probate court is much more informal than civil court. Ask Away and make noise.

Your questions are good ones, but the answers depend on a lot of things. The will is supposed to be filed within 30 days of death (but often isn't). It is a public record, though, so once filed you don't have to ask the lawyer for a copy. There's usually only one executor, often the spouse. Hard to prove the existence of a later will, unless you have a copy. You can call, write or email me to discuss.
