Legal Question in Banking Law in Delaware

My mother passed away in September of 2023. I was her legal power of attorney for all matters that concerned her. She had a credit union bank account that had me on it but I closed the account later in September. I do not have a short certificate. Her statements and tax records were set up electronically. So I got a message that her statements were available online monthly and I would access them on the internet.

What I did not know when I closed the account was that the statements for 8/2023 and 9/2023 would not be provided for her records. Now I’m not able to access any information online and I have no records to administer to her estate.

The credit union refuses to provide me with any information at all. Shouldn’t I have access to those records that were available before her date of death.

She was on Medicaid from the state because she was poor.

Please accept my condolences on the loss of your mother.

Yes unfortunately that's definitely going to be a problem. The bank is not going to give you access to those records and you're not entitled to them before being appointed by the court as fiduciary for your mom's estate.

Good luck.
