Legal Question in Immigration Law in Delaware

deportation

I am a us citizen seeking help for my boyfriend who at this moment is being detained. He is illegal and did enter the country ewi, I also believe his first attempt to enter he was caught at the border and sent back to his country. Is there anything I can do to help him.

What country is he from? From the basic facts you have provided, it is difficult to see if he has any relief from deportation. If he was caught after illegally making a reentry, he could be heavily penalized, but without more information, his situation appears difficult.

Dear Inquirer:

If your boyfriend has been ordered removed before under Section 235(b), expedited removal at the border, then he may be tried in Federal Court for illegal reentry after deportation, in which case you should seek advice from a criminal defense attorney. If he was not ordered removed when he was caught at the border, then he will be placed in removal proceedings now. Even though he is deportable, he may be eligible to seek relief in front of an immigration judge, depending on his length of residence in the US, country of origin, relatives in the US and prior criminal/immigration history.
