Legal Question in Family Law in District of Columbia

Husband and I have been separated for over 10 years, but not legally. Now filing for divorce. Deadbeat dad, absentee husband, never contributed to houselhold or child support. He has a Retirement account worth about $100K and other property. Can claim rights to any of this property?

It depends. Would need a lot more information, probably conduct a title search on the property (to see who else might own an interest) as well. Would need to know whether he came into the marriage owning the property and whether he deeded any of the property to you over the course of the marriage. The retirement account is likely something you can go after, especially if he earned the money during the course of your marriage. The best advice -- hire a local family law attorney to represent you.

Did the legal separation agreement call for child support? If so, file the motion for contempt right away. If you are entitled to tens of thousands of dollars, he may have to dip into the account to avoid going to jail. Also, if you were married (not separated) during the time the account was established, you may be entitled to a portion of the account.
