Legal Question in Personal Injury in District of Columbia

personal injury or wrongful death

my grandfather died one month before his case went to trial. the lawyers were suing for the injury of my grandfather based on the personal injury law. Is it now considered wrongful death since he died before the trial began or is it still considered personal injury?

Re: personal injury or wrongful death

Although you didn't say in your question, I'm assuming he died as a direct result of the injury that supports the lawsuit--otherwise his death is irrelevant to the case, except the estate can't sue for pain and suffering. If the negligence supporting the suit was the cause of death, your attorneys should amend their complaint to a wrongful death claim.
