Legal Question in Family Law in Florida

Grandparents rights

My daughter is in prison and has a 4 month old baby - I have the baby 3-4 times a week and the father has her the remaining time. The baby's father is a 5-time felon and does not care for her the appropriate way. My daughter has assigned me LIMITED POWER OF ATTORNEY - giving me rights over my grandaughter. She sent this from prison and it is notarized. How would I execute this POWER OF ATTORNEY and would it stand up in court?

Re: Grandparents rights

I'm not sure exactly what question you are asking but let me take a stab at it.

If you want to know whether a power of attorney from one parent will somehow give a grandparent the authority to overrule the other parent in regard to decisions involving the child...the short and general answer is no.

Note that there are exceptions to every rule so you should consult with an attorney who can review all of the facts of your case and give you an informed opinion.

If you truly believe that the natural father is endangering the child then you should report the situation to the appropriate authorities.
