Quiting Job & Selling Assets

have just learned that my husband quit his 122K plus job (he is an owner/operator) and sold his equipment to keep from paying me alimony. He began planning his departure 1 yr before he left (sold boat, pickup truck, etc)went for temporary hearing, judge said i proved need, but he showed up with 122k 1099 and a net income of 18k on his income tax and she said i couldnt prove his income. His discovery was due last friday and am still waiting on it. What are my options?

File a Motion to Compel discovery to get him in front of a judge who will require him to send you the discovery.

There is a lot of case law out there in re: persons who are voluntarily unemployed and/or underemployed for the purpose of depriving the other spouse of sufficient child support and alimony. But these are complex issues that need to be researched on a case by case basis.

I suggest that you retain an attorney who can review all of the facts of your case and pursue an adequate remedy for you.
