Legal Question in Bankruptcy in Florida

authorized user on credit card belonging to someone filing bankruptcy

My father in law had a credit card on which he listed my husband as an authorized user. He and his wife live in the same city as we do, but he worked in another city and rented a room, and was only home occasionally, so my husband was able to go and buy things his mother needed with the card. They are now filing bankruptcy, and the credit card company is sending us letters saying that we have to pay it now. Is this correct?

A specific legal opinion to this question would require more onfo. for me. I can provide a general answer.

You may want ask the credit comp. to provide you with proof of your husband's signature on a contract. If his name is on the account as cardholder or guarantor, he could be liable for the debt. If he was just a user, it may be that he is not liable. That is why you need to see a copy of the initial contract and any subsequent contracts. As an aside, if the account is older, the comp. may have sold it to another company. Often in these cases, they will not have or be able to obtain any original signature pages.
