Legal Question in Business Law in Florida

I have my business license ect. and I'm selling shoes on FaceBook. Is it okay for me to use Marilyn Monroe for a profile picture? On my Facebook retail page or is this against the law?

If you use a profile or illustration of MM which trademark rights are owned by another person/entity, you are subject to legal action for violation of such rights.

As a Franchise Attorney I basically agree with the other attorney answers. If you use a copyrighted picture without permission, you are infringing on the owner's copyright and can be sued. Consult with a good business or franchise attorney in your area for specific advice.

The owenrship is vested with "Legends" its an entity in Indiana. You would need to secure a license agreement with them. You can use your browser to contact the sales representatives there. Hope this helps.
