Default on payment

I entered an agreement with a landscape contractor who has refused to pay my design fee; I am an registered landscape architect.

What are my options?

You can sue him for breach of contract. I would send him a demand letter by certified mail, regular mail, and fax demanding payment on the account and giving him 10 days before you turn it over to an attorney to take further legal action.

If it is under $5,000 you can sue in small claims court. Above that, you should consult with an attorney.

You can sue him for your fee under your contract. You may have a lien right depending on the stage of the project. If the anmount is not too terribly much, you can pursue the matter in small claims court without the necessity of having a lawyer (unless you are a corporation -- in which case you will be required to employ a lawyer).
