Legal Question in Business Law in Florida

Hello,

I run a small company and one of my customer has not paid me, therefore I have not been able to pay my forwarder. I have another customer and I have given the freight to the forwarder, now, they are telling me that the freight is on hold cause I have not paid, and it is a different customer.

Is it legal o hold freight for non payment?.

Any business or franchise attorney will say it depends on the terms of the contract you have with the freight company, as well as their policy on the subject. They want to get paid, which is every businesses mission statement. It's a business call on your part: pay them for the unpaid amount or perhaps pay on a COD basis for now until things sort out. Check your bill of lading. Generally, they cannot legally claim a lien on freight of a different delivery. But you still owe the $.
