Legal Question in Constitutional Law in Florida

Subpoena

Is it all right to write or mark on a subpoena that you are issued by the court? Can this subpoena be subpoena'd to see if you wrote or made a mark on it? In other words, in the document I have made some notes in the columns and I was wondering if they can be used against me.

Thanks,

Mike

Re: Subpoena

Notes of any kind are eligible to be viewed in the courtroom when used by a testfying witness. It does not matter what they are written on. The copy of the subpoena you received is yours, not subject to inspection by anyone else with the exception of the introduction to this response. It is not illegal to make notes on your copy of a subpoena - it is yours. If you don't want your notes revealed, don't take them to the courtroom. You are free to destroy your copy of the subpoena, so long as you honor its commands for you to appear.
