Legal Question in Credit and Debt Law in Florida

Bill payments

I have written a company to make arrangements to pay a certain amount on my bill until it's paid. My checks have been accepted & applied to the balance, but my monthly bill reads ''past due.''

Can the company turn this over to collection under these circumstances?

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. If you do not agree, then stop right here, and do not read any further.

If they have not agreed in writing to your proposed repayment plan, they are not obligated to accept it. They could turn the debt over to a collection firm, but most likely will not as they would have to pay up to 50% of all amounts collected to them. As long as you continue to make payments, they will probably leave it be.
