CACV Credit Card Lawsuit

My wife had a card with another company and after being charged off in 2001, CACV has bought the account and is suing her. The original debt was $1500 they are now suing for $6000. We are going to court and have done some homework in ways to get this dismissed. We asked for a ''proof of debt'' and have a court date set for tomorrow. What upsets me is the lawyer isnt even from our city, she is not making the 3 hour drive to come to court but rather calling in while we go to court. Is there not some appearance statue that she has to show up or anything about to much time has gone by to sue my wife????

The rules of judicial administration give the Court wide latitude to allow telephonic appearances. There's absolutely nothing improper about this at all, and no there's no statute.
