Legal Question in Credit and Debt Law in Florida

If your car is totalled and the insurance company pays off the leinholder(1st lein-ford motor credit) and then sends you the balance in a check in your name only- but there is a 2nd lein that was from a credit card company that put a lein on the car but the ins.co. did not pay them they sent the check directly to the owner of the car- can the owner cash the check without legal ramafications
