Legal Question in Credit and Debt Law in Florida

Collection Attempt over seven years old

I am currently a MD resident. During 1994-1995 I lived in Plantation Florida. I received a collection attempt from Florida From 1995. Since this claim is over seven year old, I have no way to prove I paid it. I do not have Cancled Checks, bank statments, Bank name or account. Can they collect this from me?

Re: Collection Attempt over seven years old

The statute of limmitation , if it is applicable to you, provides an absolute defense to the alleged claim. Also, if it is applicable, you would have a claim for violation of the FDCPA. See your local competent creditors' rights specialist.

You should at least contest the debt, if in fact you paid it. Your message is not clear on that.

Unless they have a judgment against you the debt is stale and you needn't pay.
