Legal Question in Credit and Debt Law in Florida

Contract Violation?

So when I was about 16 my family signed up at the local gym. Everyone had to sign the contract, I asked what I was signing for and they said liability in case I got hurt since I was a minor. Basically two months ago the credit card my mom had on contract expired, and they started billing me without notification. I'm 18 now which is how they probably started to bill me. So i have 160 dollars in money owed to them, and in 5 days the gyms financial company which has been billing us is going to advise them to seek ''legal action'' or so says the letter. Now if I never resigned a contract, and was just on the plan as a family member, not the contract starter, how can I be billed? Once my mom went to the gym since her credit card was expired they just told her that she is no longer a member. So they have ceased to bill her, yet now they bill me. I was never notified by them that I was now paying for the account. Until I got a letter saying I was behind two months. My mother failed to tell me about the incident I mentioned. So in a sense I was left out to dry. So are they allowed to start billing me without noticing me. If the contract says they are, can they get in trouble for telling me incorrect information when I signed as a minor?

Re: Contract Violation?

You were a minor and are not responsible. This is a clear violation of both the Fair Debt Credit Act and the Unfair Trade Act.

If you are in south Floida, call me.
