Legal Question in Credit and Debt Law in Florida

Freeze Bank Accounts?

I received a notice to appear for pretrial conference/mediation for an unpaid credit card. This card is from over 8 years ago. I do not wish to appear and cant pay. I know a judgement will be placed. It is in my former last name. I have a bank account in my former last name as well as a new account in my new married name jointly with my new husband. I also have a car that is owned jointly with him, its paid free and clear. We got it before we were married so its in my old last name and his name. Can they take our car? Can they freeze the joint bank account that is in my new last name? How could they possibly find out about this account if it's a different last name? The car title and account have the wording me AND hubby. Not me OR hubby. I dont keep much in the other account with my former last name on it. I live in Florida.

Re: Freeze Bank Accounts?

If you received the card 8 years ago, a judgment has probably been entered against you. All YOUR non-exempt property is subject to seizure to satisfy the judgment. From a practical view no-one has the incentive to find you. So do nothing.

If you just received the card, check the post-mark. If it is a current date, you may have grounds to vacate the judgment. Consult with counsel.
