Legal Question in Credit and Debt Law in Florida

Removal of judgement ?

Credit card co. filed a lawsuit against me in early 2005 and received a judgement against me which is attached as a lein against my home. Late 2005 I filed bankruptcy, was not aware that judgement was attached to my home as lein until recently when trying to refinance. What are some ways I can remove judgement/lein against home? or is there a way to do so at all?

Re: Removal of judgement ?

You have to reopen your bankruptcy and file a motion to avoid lien, assuming the judge will allow it. Your bankruptcy lawyer should have done this during your bankruptcy. If he or she didn't, shame on him or her. If you didn't use a lawyer for your bankruptcy, shame on you.
