Legal Question in Credit and Debt Law in Florida

unauthorized access of my information

My information has been accessed by a collection agency's employee for personal use. This person did not have my authorization to access my information, and I have no delinquent accounts with this collection agency. My information has now been given to his spouse who is filing false police reports in my state. I am in the process of proceeding legally against her however I was wondering where I stood with him using company resourses to obtain my information for his personal matter. Would I have a legal case against him or the company? This person has several embezzelment convictions and the company was aware of this prior to hiring this employee. How would I go about filing charges would it be done in the state where he accessed the information (Fl) or would it be done in the state where I reside (Va)?

Re: unauthorized access of my information

There may be violations of the Sarbanes-Oxley Act as well as several other statutes. Some of these violations may even constitute criminal liability on behalf of the collection agency as well as its principals. You should consult with an attorney immediately.
