Legal Question in Criminal Law in Florida

My boyfriend is in jail for attempted 1st degree murder because the "victim" lied in his police statement. His lawyer has what I think is called a declanation of prosecution from the "victim," saying he doesn't want to press charges. My boyfriend has been waiting in jail for almost 2 months now with no bond set. The lawyer said he put in for a bond hearing almost 3 weeks ago. We're afraid he's not putting 100% into our case. He hasn't filed the declanation because he says there is no point, the prosecutor won't look at it until the trial date. But why not file it just in case he does? And does it usually take this long for a bond hearing?

No attorney on here can second guess what his present attorney is doing. The issue is between your boyfriend and his attorney. Your boyfriend should ask why. There could be strategic reasons for not doing so but only his attorney can answer that question. As far as how long a bond hearing should take, it can vary from a few days to a few weeks, depending on the county and the judge.
