Legal Question in Criminal Law in Florida

contempt of court

My ex has charged that I did not pay a bill as decided in the divorce. He has not made a settlement on our home as he was told to do or paid 5000.00 on a charge card or the back child support( $2000.00) he was told to do. DO I have the right to fight this issue and do I have to go to Florida (I have moved to Tenn) or can I contact the courts by phone or mail to state my case? Through my previous divorce attorney we have made many attempts to negoiate a more than fair settlement, but he refuses to entertain any $ amount to settle with me. We were married for 15 years and built and paid for the house together. Is any of this relevent to the contempt of court he has charged me with. I do not have any funds to hire another attorney and can't really afford a trip to Tallahassee Fl. He has tied up approximately $80000.00 of money that should be mine, because he will not settle on the house, which in turn has caused me to default on the bill and to the detriment of our daughter caused she and I hardship.

Re: contempt of court

I'm going to assume the contempt is because you moved your daughter out of state in violation of Florida law.

Here's my advice: go get a Florida lawyer. I know you say you can't afford one, but the truth is, you can't afford not to have one. Otherwise, you'll probably never see the money he owes you and you may lose custody of your daughter. If I'm right, and his motion is about moving your daughter out of Florida, your custody rights are in serious jeopardy, because Florida law says very strictly that you can't do that.

The answer to your question is yes, his contempt is relevant, but it doesn't do you much good coming from a lawyer you've never met, coming from a free website, coming from a lawyer who doesn't even practice in Tallahassee. You need to retain a good family lawyer to help you.
