Legal Question in Criminal Law in Florida

Domestic Battery Warrant

I have a warrant for my arrest that is almost 2 years old. I wasn't arrested or neither skipped bail. I didn't know there was a warrant until almost a month later after the incident. I no longer live there and its been almost 2 years. The state has no witnesses. I am wondering how long they will keep a charge active in Florida.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

They can keep it open indefinitely. If there are no witnesses, you would probably be well served to turn yourself in and answer to the charges. Otherwise, when you least expect it, this matter will show up and you will get arrested and jailed until it is resolved. It could happen from something as simple as a traffic stop or something. Take care of this now as it will not go away on its own.

Re: Domestic Battery Warrant

The warrant will stay active indefinitely. The best way to handle a warrant like this is to hire an attorney who can file a motion to dismiss of the statute of limitations has run or who can get the case activated and moving along so that the warrant will be lifted.

Please call me if the case arose out of the Central Florida area.
