Legal Question in Criminal Law in Florida

While my husband and I were on vacation our 18 year old son had a party at our home, with approx. 100 friends and lots of alcohol. My son was given a citation for Open House Party with a court date to appear. We live in Florida. Any advice is greatly appreciated.

Open House Party is a misdemeanor offense. If your son doesn't have a criminal record, he may qualify for an opportunity to earn a dismissal of the charges through a deferred prosecution agreement. However, because of your son's age, I presume that the average age of the attendees was under 21. As such, the prosecution may be disinclined to offer your son the opportunity to participate in a deferred prosecution agreement, even with no prior record. My best advice would be to consult directly with a lawyer that's familiar with the State Attorney's office in your jurisdiction to discuss you son's case.
