sale of ecstasy to undercover police

My son was arrested a week ago because of an outstanding warrant for this. According to his public defender, they have no audio or video of this sale. If he did this, shouldn't they have arrested him on the spot? He says the last time he did this was at least 5 months ago. By the way, the ecstasy isn't real. It si Remifemin pills with the butterfly logo on them. Does this make a difference?

It is difficult to answer this without a detailed look at the police reports and discovery in your son's case. Most likely, there is enough evidence to charge your son. It also most likely does not matter if the pill was not an ecstacy pill.

Thank you for your email. It is not unusual for the authorities to make controlled buys in a narcotics investigation and wait a substantial period of time to make arrests.
