Solicitation of Prostitution

To Whom It May Concern:

Today, I was arrested for soliciting prostitution during a sting operation in a parking lot with a prostitute in downtown West Palm Beach.

That said, here are my stats:

23 year old Hispanic male college student, graduated with honors 3.6 GPA, and want to apply to medical school in the future. Curently studying to take the MCAT. I have NO previous legal problems of any kind, except for 2 speeding tickets, for which I went to driving school.

They have me on camera through the windshield, but it was just before engaging in any sexual acts.

They asked me to write a statement for what happened. I said, and I recite this from memory approximately:

''I picked up a woman who looked stranded and offered to give her a ride. I am currently depressed, which is true, from a nasty breakup with a girlfriend. Sometime just before I was going to drop her off, the woman offered me sex. I vacillated, but out of loneliness, gave in. We parked in a random lot, and she asked me for 20 bucks, and I just handed it to her without speaking, and she pulled out a condom, which I put on. Then a cop showed up and busted us.''

I was given a Juvenile ''Notice To Appear'' referral for Oct. 30th.

Any Advice to expunge?

From the facts, it is imperative that the charge be dismissed or that adjudication be withheld because you will not be able to expunge your arrest record which could be uncovered in any background search for the rest of your life.

You must first get through the trial stage before you can even be concerned about sealing or expunging your record. With all that you have on the line, you would be well served to hire a good criminal attorney who may be able to either get the charges dismissed on some technicality or impropriety or alternatively the attorney may be able to convince the court to refer the matter to a pretial diversionary program. An attorney can work with the State in order to minimize your exposure and try to keep you from being convicted or alternatively from having an adjudication on your record which is required for any possibility of sealing or expunging of your case file and record.
