Legal Question in Criminal Law in Florida

Stalking charge on record

In 2000 my ex-husband was arrested for harrassment. I didn't want to press charges yet the State of Fl picked it up. I filed a dismissal in 2003. Yet the Stalking charge still shows on his police record yet no arrest shows.

When it is taken care of in court does it not get taken care of by the Police Dept? How do we get this taken care of.

Re: Stalking charge on record

In order to confirm the status of your ex-husband's arrest history, he will need to order his criminal arrest record from the Florida Department of Law Enforcement (FDLE) (he can do this online via the FDLE website). If the case was dismissed and he has not been previously adjudicated guilty or delinquent of a criminal offense or comparable ordinance violation, then he should be able to have his record expunged. I handle sealing and expungement cases statewide. Please contact me if you have further questions.
