Legal Question in Criminal Law in Florida

Ticket for DWLS and on Probation

My brother was pulled over and given a ticket for DWLS. He is on felony probation. Will this violate his probation even though he was not arrested?

Re: Ticket for DWLS and on Probation

When you are placed on probation you agree not to violate any law, so it isn't the arrest that is important.

Whether or not he is violated is generally up to the probation officer; but when the person picks up a new offense I have been told that it is the departments policy to violate the person.

There is always a slight chance that he won't be violated, to increase these chances I would make sure that he has a great relationship with the probation officer.

If the violation is filed he would be opening up the posible sentence for the first felony. He could be in trouble, especially if the first felony was for a driving offence.

Feel free to give me a ring if you have any questions.
