Legal Question in Discrimination Law in Florida

My wife responded to an advertised job ad which was done through the Career Center for Castle Dental. After my wife obtained and filled out the appropriate paperwork that the Career Center gave her, which included a document for the potential employer. The Career Center is a Florida State run facility. When my wife went to the potential employer she was told by the manager just hand in her resume and the paperwork from the Career Center and was not asked to fill out an internal employment application. Hispanic discrimination is common in Hernando County and there is no doubt this was discrimination. It is improper proceedure for any company not to have an applicant fill out an internal employment app. especially when they are advertising for a job.

What can we do?

First you have to calm down. You have no proof of dicsrimination but rather are assuming that was the reason for the problem. You can't accomplish anything if you're not level-headed.

Second, it sounds like an application was in fact filled out. So why would a second one need to be filled out? (There's nothing improper about that if the first one is good enough to begin with.) Your wife should contact the center and explain that she was not asked to fill out the second application - should she come back and do so, or is it not necessary? She should also ask why she was not considered for, or was denied the job. If nothing else, perhaps she will get some useful information.

Third, if she continues to believe that discrimination is at play, she should file a complaint with either the EEOC (Tampa area office - 813.228.2310, Miami area - 305.536.4491) or the Florida Commission on Human Relations (904.488.7082). Be sure to file "jointly" under both Florida and Federal law. There are time limits involved, so do not delay.
