Legal Question in Discrimination Law in Florida

Sexual Harassment Training

Are there laws in place in the State of Florida or elsewhere in the U.S. that makes sexual harassment training mandtory for a company? If so, how many times must it be taught and how often?

Re: Sexual Harassment Training

There is no law that mandates the training per se, but Supreme Court case law basically makes it required. In summary, the case law says that if a company does not have training and a policy in place, it is very hard if not impossible to successfully defend against claims.

An overall training session shold be done for all employees. Then updates can be done yearly (or more frequently if there is a lot of turn over or there are specific problems that need to be addressed.)

There are all sorts of training programs out there ranging from a few hours to multi-day sessions. Costs usually range into the several thousands of dollars.

I have offered my clients a basic training course for years. It consists of a review of the law and company policy (I can draft or revise policies for companies as well), along with examples of situations to look out for. My fees are much lower than any training company or other attorney that I know of, and are based on just how much work needs to be done. I try to keep the sessions to no more than 2 hours, plus more for extended Q&A as necessary.

Please call for a free consultation if you have other questions, need to review your company's obligations or might be interested in training.
