The short answer is yes they can charge. the long answer is much more complicated because they would have to prove it up, which would be nearly impossible.

I am not familiar with that drug, but the DUI statute provides that you can be charged if you are under the influence of a "controlled substance" to the extent that your normal faculties are impaired. It is not always necessary that there be alcohol involved.
