Legal Question in DUI Law in Florida

Fleeing the scene of an accident, and dui.

I rear ended a car as they were turning. I saw their tail lights disappear into the apartment complex. My friend and I didn't have cell phones, so we proceeded to walk down the street to call the cops. Well my friend, age 19 I'm 21, also left his opened beer in the cup holder in the car... Someone had already called the cops and they found us walking down the street a short distance from the scene of the crash. They drove us back and now I have to appear in court and explain why I left the scene of the accident. Can this turn into a dui because of the open container?

Did the police have you perform field sobriety tests or a breathalyzer? If not, you are in the clear. You may have an open container charge but an open drink alone is not enough to charge you with a dui.
