Legal Question in DUI Law in Florida

open alcohol container law

What constitutes an ''open'' container of

alcohol in a vehicle? Is it just a container

that cannot be resealed (ie: a beer bottle) or

would a closed, but not full, bottle of liquor

be included?

Re: open alcohol container law

Any container of alcohol that has already been opened could constitute an open container. Thus, a closed, but not full bottle of liquor may constitute a violation.
