Legal Question in Entertainment Law in Florida
who can hold the copyright
I was a volunteer with a community agency, The paid supervisor was asked to prepare a song. I prepared the musical background, the first verse and the chorus. the supervisor and another staff member assisted with two verses. I went ahead and copyrighted the song in my name and the staff members names. I have now been accused of betraying the agency because they requested the song and that they should hold the certificate and not me. I was not an employee so work for hire does not fit. How and I include them and not lose my rights to the song.

I would only license the use of the song to the community organization and retain the copyright for yourself. You should speak with an attorney to prepare the copyright license agreement and the terms of such.

The supervisor and the other staff member may have a problem, but it appears you do not. If it's worth it and if the community agency is interested, you may want to license the song to the community agency. You need to seek more in depth counsel with an attorney for preparation of a licensing agreement. Seek the advice of counsel and good luck.
