Legal Question in Family Law in Florida

Biological Daughter

My oldest daughter is not my biological daughter. However, I have been with her since birth. I am the only father she has ever known. At the age of 6 years old her mother and myself got a divorce. Her mother has allowed her to have visitation with my other daughter so far and she will be 14 years old this year. Her mother is emotionally unstable and I always worry whether she will take my visitation away from her. Do I have any legal right to maintain visitation with her?

Re: Biological Daughter

If you were established in your divorce as the legal father in the divorce, she could not legally interfere with visitation. If she has not been established as your legal child, then she could prohibit visitation.

You've had visitation with the child for eight years? When did the mother become emotionally unstable? It sounds like you might be in different states. If not, the problem may be resolved by the child deciding if she wants to visit. Visit at the library, a church, school functions.
