Child safety

My ex and I have shared custody of our children, but they live with her. The problem is my ex lets another guy around my kids who has had problems in another state. The state had taken his kids away for several reasons, he has had 2 restaining orders put against him by 2 other individuals. On several occasions I have witnessed him there. I have called Child Services but they said I have to make a claim, I don't want to be accused of making false accusations but I would like to know if I have a chance at getting custody of my kids so I can ensure that they are safe. Another thing is I don't have a clean record myself but that was before I was married, would that hurt me?
