Legal Question in Family Law in Florida

Father went back to college and just stopped paying child support

My ex decided to go back to college in another state and has stopped working to do this. I no longer get child support even though there is a court order in effect. Can he legally just stop paying child support just because he wants to be a full time student? Would a judge allow this?

The short answer is no. You will need to file a motion to make the Court enforce your order. The Court can compel him to work and make at least some payments and he is not unilaterally allowed to stop paying. He cannot unilaterally decide to ignore an order of the Court. However, in order for the Court to enforce its order for him to pay child support, you are going to have to take him to back to Court.
