Legal Question in Family Law in Florida

Child Suppory

I would like to ask a simple short question. My husband pays child support. I would like to know how often that he can be taken back to court to raise the support. We are finacially responsible 100% for the kids as the mom doesn't work. But she has caused us so many problems. We just would like and idea of when it might happen again. We are not gripping about the money cause it is for the kids. They deserve it. Thank you very much for your time.

Re: Child Suppory

To change the amount of child support, either parent must show the court that there has been a "substantial change in circumstances." So, if your husband's income increases, if the children have changed needs because of some medical problem, etc., the mother can ask the court for an increase in support. Likewise, if your husband's income decreases greatly, or is unemployed or unlikely to earn as much as he once did, he could ask the court for a decrease in support. There's no limit to the number of times, but the party must show a substantial change in circumstances to modify provisions re support, visitation, etc. in the court order.
