Custody

My Ex wife is moving out of state to go to school and wants to leave my sons with her Mother instead of letting them live with me. I have remarried and we are capable of taking care of them. I also have a very close relationship with my Sons. Do I have any rights. My ex wife says I do Not.

A short answer is, assuming your parental rights have not been terminated, yes. You have rights.

Generally, yes you have rights. As the Father of the children you have a primary right to have custody over the children over anyone other than their mother (this is an equal parental right).

I do not know the divorce determination regarding custody or the situation on why your ex-wife would think that her mother would be the proper custodian of the children. If you wish to discuss this further, you may e-mail further details, your phone number and a good time to reach you.
